About Limited Exemption
Section 500.19 provides a limited exemption for small businesses that meet all three criteria below. Exempt entities still must file a Notice of Exemption and comply with certain requirements including incident reporting and maintaining a cybersecurity program.
Does your company have fewer than 10 employees?
This includes employees and independent contractors of both the covered entity AND any of its affiliates.
Is your gross annual revenue from NY operations less than $5 million?
This is calculated as an average over the last 3 fiscal years. Include revenue from all NY business operations of the covered entity and its affiliates.
Are your year-end total assets less than $10 million?
This is calculated based on GAAP. Include total assets of the covered entity and all its affiliates at the end of the last fiscal year.
